Massachusetts Privacy Law

To protect the privacy of residents in Massachusetts, a new state regulation has recently come into effect (201 CMR 17.00) that requires mandatory encryption of all sensitive customer information sent out of your business. In combination with existing data breach disclosure laws, you may be liable for unlimited financial penalties if you do not use encryption to protect customer information.

What do I do differently?

This new regulation means that you need to look at how you handle, store and transmit sensitive information and make sure that you are encrypting in all the right places.

  • Handling sensitive data – it is always advisable to encrypt any internal communications that involves customers
  • Storing – Files and documents with sensitive customer information should be encrypted
  • Transmitting – Email is often used to communicate with customers and business partners – all outgoing communication must be encrypted

How do I comply?

  • All email communication that contains credit card numbers, social security numbers, drivers license numbers and similar personal information must be encrypted
  • All files and documents containing sensitive customer information must also be encrypted
